Why should courts give orders that are beyond their powers? Why give an order that's not enforceable? The judiciary, and the legal profession are the most anti reform institutions we have in the society. They insist on using Latin (with a tight upper lip) even where simple English or Swahili would be sufficient. They belong to the ivory towers. A society where laws are made and we mere mortals should trend in awe and only when invited.But BBI lazima ipite.
1.The court ruled that Nairobi Metropolitan Services is an illegal outfit.
It still runs Nairobi, with a budget.
2.The court ruled the parliament is illegal as currently constituted.
MPs still make laws, approve budgets & draw salaries.
3.The court ruled the transfer of KMC to the military was irregular & therefore illegal.
4.The court ruled that 41 judges be sworn in.
They haven't been sworn in.
5.The court ruled that CASs were illegally in office.
CASs are still in office & will continue to as they draw illegal salaries.
6.The court ruled that miguna should return and his passport given back, the government disobeyed the orders

I believe in simple law making. I believe that rules of procedure should be simple enough for you to represent yourself in a court of law.

Ni ruling gani court ilikosea hapo....are CASs supposed to be in office....are they envisioned in the constitution....jibu swali..

There was a blunder in creation and recruitment of CAS. I can't defend rewarding of political rejects using public funds. Siyo poa.
Not really, they spoke the law, stated as it is but ego filled executive will use force instead of brains.
The executive is pari passu with judiciary but since the executive controls law enforcers and finances they feel they are the muscle.

Can it be asked whether the formation a 5 judge bench was designed to circumvent the appeal process? Remember that the judiciary is an interested party in the BBI.
