I suspect that guy does not intend to live there. He is bulding the house for people who live in flats. What those other guys should do is move to another area without high rise buildings, abandon their current houses and put up high rises in their place.

But people who like stepping on other's toes, especially stepping on the toes of a whole community, they don't get far. A fire starts, your car loses brakes, or a gang of thugs waylay you and carjack you (or kill you) etc etc...

happened in the estate I was brought up in.. enzi zetu zilikuwa maisonettes... with a garden mbele na nyuma.. siku hihi huko ni hizo flats tu the place has become a slum..

Kuna club hukataza watu kuingia na miraa, hata kama pesa ni zako. Watu wengine wanapenda kuishi kwa nyumba za chini nyuma ya fence. Ukijenga ghorofa watu wale wako kwa ghorofa ni kuchungulia majirani zao na kuchukua video...mkiogelea, watoto wakicheza, mkila kwa patio, mkimangana kwa veranda etc....starehe zinakatika.

He's just a normal guy. But I think his argument is logical.
It is logical yes, but how about those neighbors whose lives will be affected or who will be forced to move out. You should take him to court and prove that his actions will affect your quality of life. If you can show that he was aware of the neighborhood laws, he is likely to lose. For many years, developers have lost to homeowners associations.

There's this "gated" community somewhere that has rules against putting high rise buildings. A guy buys a plot there and sets up to build a 5-floor flat. Gets all necessary NEMA, NCA and kanjo approvals for the same. At third floor, he receives a letter from the resident's association informing him that the area is controlled and he cannot continue with the project. The guy replies that he is not a member of the association and is therefore not bound by their rules. He continues to state that the resident's association has no mandate in approving or disapproving his project as there are government agencies constitutionally mandated to do that work.

Are homeowners association mandated under any law to control buildings? That's the work of various govt agencies, and if they are OK, then hatuna kesi. Zoning laws are a preserve of kanjo, not neighbors.

Kweli kabisa. Lakini hapo huwa tunajali etiquette ya patrons kwa club iko aje, sio mwemye club. The owner himself labda ni mtu wa kuchonga kabisa lakini kwa sababu ya hali ya wateja wake anapiga marufuk. What is likely to happen neighbors wa huyo mtu watahamia kwengine ambako hakuna high rise, lakini kuna uwezekano mkubwa watamkabili kichini chini. Vile tu utaingia matatu yako binafsi na hautasmoke kwa kuwajali abiria.

Housing associations need to include the local authorities when coming up with some of the by laws, reminds me of runda when they were refusing people to use that public road that joins kiambu road, siku hizi niliona there is another road joining the bypass.

Kipchoge Keino bought a piece of land around Eldoret town and built his mansion. Soon others followed suit and became his neighbours. Together they formed an association and were very strict. Hakuna highrise. Till today hakuna mtu ametokea na yake. The plush area they started is the famous Elgon View estate

Currently dealing with a similar case somwhere along kamiti road...... the clients wants to put up 1 story building with two 3bdr apartments for rent with a flat roof but the "estate regulations" states that all the house facades should be the same and no rental houses are allowed. January nxt year tutakua kwa ground. If i didn't sign any binding agreement when i bought the plot you ain't telling me shit.
