It might be published formally some day. I say might because I chanced on more exciting and rewarding phenomenon in the course of the exercise.

Kweli kabisa, I have sat down with Officers and most have proven ability in tackling crime and are not interested in bribes (but hawakatai gift after job well done). I am interested in his data, if he cared to share it can assist in remedying the situation.
Trust me, if such data does exist it's fake. The methodology required to collect it is just too complex and prolly impossible; first you'd have to have access to OBs and counter-reference them with court files, you'd have to provide for those cases that are withdrawn by the complainant, etc etc.

What looks impossible to you is what others do without effort, everyday.
 
Either the three could not raise enough money to buy their way out or the cops were too crossed that someone was trying to invade their territory. In such situations, the bribe is raised to match the benefits they would gain from continued employment, which means it is in the hundreds of thousands.

Most of the petty cases are solved in out of court settlement and arbitration, where parties to the case solve their issues and write a withdrawal statements. Criminal cases can only be taken to court after sufficient evidence is at hand, unless you want to waste the precious fuel taking a suspect that will be released immediately after arraignment 70 Kilometres away. This has been a bone of contention to many who expect pre2010 approach to policing, where you report and suspects are arrested kept in the cells as evidence of the crime is being collected.

I also agree that we have some rotten apples in the police service, I have witnessed that firsthand, the solution to that is to escalate the matter to a higher office and in most instances the issue is solved to the members of the public satisfaction, after all police are employed to serve the public. If that doesn't work internal affairs unit of police is quite effective in dealing with errant policemen/women.

I just received similar advice from a pal regarding a lady cop who has decided that my mandazi kibanda is what will feed her family.....

How does one identify unwarranted arrest?

Insist that they take you to the Police Station. In other words do not resist arrest and do not bribe to be let off.

If the arrest is not legal because they do not have authority or locus stadi to do so, they won’t take you to any Police Station as they will be incriminating themselves

The problem with us Kenyans is that we do not like going through the due process and quickly buy our way out through bribing.
It is this mortal fear of being taken to Police Station and being arraigned that these crooks exploit.

I think as a country we should make the process of being arrested and arraigned less demeaning and traumatic. After all being arrested does not mean guilty till proven so through trial.

Minor misdemeanours like traffic offences mentioned in the original thread should be cited. You get a ticket and the accompanying paperwork from the Officer on when and which Court to appear or how much penalty or fine to pay.

That way, one needs not go to a Police Station or be Processed for overnight stay in a Station.
Of course a lot depends on whether one is a flight risk.
