Weak/Lame spin from The Star: in the headlines

But again,if he has a dossier on a recruited individual(s),which he didn't present during the recruitment, for reasons only known to himself,he might use it to decline to appoint the recruited individual(s).

He cannot decline to appoint them because the Constitution requires him to appoint only, he has no power to decline.

The reason is simple, natural justice is a key tenet of our constitution and a key plank of this ideal is that a person is given the opportunity to respond to allegations levelled against them, that is what would happen has his way, the President becomes the prosecutor and judge at the same time, a situation that is more akin to a monarchy or dictatorship than a democracy, is that the kind of nation you want to live in?

I do not want to live in under a dictator but we been living in a 'dictatorial democracy' all through and the natural.justice you are talking about has been there all through. That has not prevent natural justice from being diverted, tramped on and so on and so forth for so long. Our guy is just following precedent. And that act of declining to appoint the recruited persons must have had reasons behind it.

@Mr Black do you really believe that whatever scenes you see played out during these exercises present the whole picture all anchored in the constitution whose 'spirit' you are quoting here?

Mpaka maraga akastuka...
@Meria just because you do not believe it does not mean casting aspersions on those who do.
And who told you it's a spin? From the house on the hill? We won't believe your spin if that's what you want us to. Faga!

What would have happened if the President had attempted to give an advisory before the process of recruitment was over? Wouldn't he have been accused of meddling again?

@Mwalimu-G , you know these things can be done quietly behind the scenes. It's okay with me for a President to hint on his preferences in a give-and-take backroom negotiations. Also for the president to indicate those names he absolutely do not want on the list for political reasons. In the current embarrassing stand off, the backroom process of communications seem broken and I am not sure who to blame. It can't be the President or the CJ because they have to be above board without being seen as meddling. Not sure who in the president's circle of CJ point person has failed president on this one. It's just embarrassing !
