Since all applicants are normally qualified for the seat, all the JSC does is regional, racial, religious.... balancing. With that Somalis / muslims get a seat.
There was fear that Ruto might want to push Katwa Kigen thru., he still has a chance next year when Philomena retires in April 2027.

Kigen will get in at some point. Be it from Philomena's retirement, Njoki Ndung'u's appointment to the ICC, or the exit of some other judge for any reason.
