WHY YOU MUST LOG INTO COURT AND KICK OUT THE INCOMPETENT AND CORRUPT LADY JUSTICE JOSEPHINE MONGARE
I will get straight to the point and elaborate later. Lady Justice Josephine Mongare should not continue presiding over matters, and if she does, her Court must be boycotted. The boycott should be undertaken by Advocates logging into her Court, and asking her to go clear herself before the EACC first. A Judge facing investigations on complaints of bribery, cannot have the legal or moral authority to determine disputes between and amongst Kenyans.
I have known Lady Justice Josephine Mongare since 2017. I met her in FIDA functions. I contributed hundreds of thousands of shillings and time towards the activities and elections of FIDA when she chaired it, and thereafter. I do many of these things to gather intelligence. I got to know her in detail. An affable person but inept and without depth as an Advocate. Her pupils and employees attest to the fact that she was a below average Courtroom practitioner.
I have appeared before Lady Justice Josephine Mongare for the last two years. She presents herself as civil, friendly and knowledgeable but wait until she delivers her rulings and judgments. Often, her decisions are between 3 to 6 pages. No appraisal of evidence or submissions. No reference to any Statute. No reference to any Book. No reference to any case law. Just her mind. Her mind is the law.
Lady Justice Josephine Mongare and I fell out sometimes in 2024. I wrote an article on corruption as the reason surrounding the brutal killing of a Magistrate in Court. The Magistrate had been shot by a policeman over a bribery deal gone bad. That is a fact, established from my interview of the Advocate for the accused person in that case, and other witnesses.
When I appeared before Lady Justice Josephine Mongare, she admonished me for “dancing on the grave of a judicial officer.” I told her off, and asked her to concentrate on the business of the day. I am not the type to be given irrelevant lectures by anyone, let alone a corrupt and incompetent Judge.
Thereafter, I lost all cases before Lady Justice Josephine Mongare. A mutual friend disclosed to me that the Judge had resolved to teach me a lesson. I asked the mutual friend to go tell the Judge that I will instead, teach her a bigger lesson: she will lose her job as a Judge.
The clients in the Gikomba matter bluntly told me that they were aware that Lady Justice Mongare had occasioned a grave miscarriage of justice in their case, because of the animosity between her and I. They had been advised to get an Advocate who would work with the Judge. I said that, that is okay and surrendered the file to them.
It later transpired that Lady Justice Josephine Mongare dispatched an agent to collect Kshs 5,000,000.00 on the matter. The agent collected but for whatever reason did not deliver the entire amount to the Judge. The Judge jailed my clients, and refused to undo her order even after being directed to do so by the Court of Appeal. You can see an angry her in the clip I posted sometimes in August, 2025. She was signaling that the balance had to be paid.
The JSC exonerated her of the complaint I made on the matter. I understand that Kshs 10,000,000.00 was used to procure the verdict of the JSC. The verdict was secured at the intervention of Mr Justice Alfred Mabeya and a commissioner of the JSC, closely associated with the Judge, and who and also acted in the matter.
Undeterred, I have sued her, and her teacher in corruption, Mr Justice Alfred Mabeya. The clients came back. Of course, the two Judges may, if they succeed, find a way of securing a determination in their favour. It does not matter. We are doing it for the record. Most wars are waged to test firepower. They need not all be won.
It does not therefore, surprise me that Lady Justice Josephine Mongare has been implicated in the bribery scandal in which she dispatched former Judge Joseph Mutava to solicit Kshs 10,000,000.00 from Raphael Tuju. It was just a matter of time. If you check the records, Joseph Mutava was removed from office on my complaint and testimony.
Lady Justice Josephine Mongare is using the former Judge’s rule book. The former Judge secured a judgment of the High Court stopping the JSC from probing him. The JSC then, was resolute. It appealed and overturned the judgment, a Tribunal was formed, and Joseph Mutava was removed from office. Check the newspapers. We conducted a three year serious media campaign against him. It worked. X and Facebook was not effective then as it is today.
Lady Justice Josephine Mongare is well connected in the Judiciary and the JSC. Her FIDA connections are deep. She also has some networks in the Executive. I do not foresee any respite in the efforts to hold her accountable through established channels. She can only be dealt with through unconventional means. In fact, I want her to sue me so that I may bring the battle much closer to her doorstep. She goes low: we dig the grave, lower her in and put some soil, and finish the matter. In the meantime, let us log into to her Court on Monday next and continuously thereafter, and ask her to go clear her name first before handling any matters. That is what we would have done if Court was physical.
