Supreme Court chronicles

Eric Gumbo: As to whether the technology IEBC used in the general election was successful; 46,201 KIEMS kits worked out of 46,229, this is more than 99%. Even in our education system, an A is not 100%.

You can be 99% accurate and still fail to get an outright winner if the 1% error significantly affects the outcome of the election. If the margin of victory is very small, i.e less that 1% and 1% error rate, then you have a statistical tie. However IEBC data shows that Ruto's margin of victory is 1.64%.

That's why elections with landslide victory like Kibaki's against Uhuru are so hard to contest or steal.

So, if your car takes you for 999kms, breaks down and you walk for 1km to your destination, shall we say you didn't arrive?

No. Precision in measurement must fit the purpose. If you are measuring the length of a plot for planting maize, you won't need the same level of precision as when you are building a 10 storey building.

Every election, like every other measurement has a margin of error. This error measurement becomes more significant as the winner's margin of victory decreases. Closesly contested elections require lower margins of errors to produce a winner.

Failure of kits doesn't equate to an error.

Mahat Somane: If you uploaded a modified form on the IEBC portal, the system would have issued a report giving details of who did the modification and at what time.

MAHAT SOMANE: The submission made Julie Soweto alleging 33 per polling station stray ballots in Kirinyaga county, I don’t know what numbers they’re using; an old litigation strategy in numbers for shock and awe.

Mahat Somane: We have done an error report for each and every polling station in the country. In paragraph 96 of Martha Karua's affidavit, the petitioner alleges a variance of 25,000 between the position of governor and president. The correct position is a variance of 900.

Voter turnout percentage as kept being reported at Bomas was in respect of reporting KIEMS kits NOT total registered voters.

Abdikadir Mohamed: All roles given to Mr Chebukati by the Constitution and other laws define a returning officers. The four dissenting commissioners may not have understood their roles.

An egg on their faces, the supreme court at the end of this petition should dismiss with punitive costs to the petitioners and damages to IEBC and Kenya Kwanza, there is no way triviality, political negligence, outright lies and figments of imagination, should be brought before the highest court of the land.

Hapo sana, the court should make it so expensive and damaging to use it to deny Kenyans their rightful President and waste our time, they should have Azimio and their surrogates pay IEBC's and Ruto's legal bills, that should be an effective deterrent.

Abdikadir Mohammed: Fracas at Bomas prevented IEBC from announcing results from 27 constituencies. Petitioners alleged results from these constituencies had not been tallied.
