You have to ask yourself, how does the supreme court work? First a petition must be put before it, and then a panel selected to sit and come up with a majority decision which formulates an order from the Supreme Court.

The key difference is that, this were more or less guidelines from the president of the Judiciary, CJ Martha Koome on how people should behave when a petition is filed in the SC. They are therefore not Supreme Court orders. Therefore, they are subject to litigation at lower courts.

So, basically you're saying this isn't a decision of the court, but rather the president.
