Nairobi motorist to pay Sh. 50,000 fine only for killing child

A Nairobi motorist has been fined Sh. 50,000 for killing a primary school pupil. The motorist who was identified as Rodgers Ochomo killed a pupil at a zebra crossing near the Lang’ata Barracks gate in Nairobi on March 26, 2019.

He was set free by the Kibera Law Courts after he paid Sh. 70,000 He paid a Sh. 50,000 fine for killing the seven-year-old pupil and another Sh. 20,000 for causing grievous bodily harm to another one.

Failure to pay the fines would have seen spend one year in jail according to the sentence that was read out by Senior Principal Magistrate Philip Mutua.

According to the court filings, on the day Rodgers killed the pupil, other motorists had stopped to allow school children to cross at the designated crossing zone. Reports say that a Kenya Wildlife Service driver Benson Mugambi had signaled him to stop. However, Rodgers opted not to stop and proceeded to hit and kill the first pupil, and injure the second.



During his case, Rodgers has flip flopped between guilty and not guilty. He had at first admitted the charges but later, denied the charges before pleading guilty again. The prosecutor has however said that this sentencing was too lenient and that an appeal will be made.

Judge might have weighed the options and so that fit for him to pay for his carelessness not for the life of the child.
