Whether abortion or infanticide has taken place is not a legal issue but a medical one. It is only a medical doctor who can ascertain with surety what somebody died of, through autopsy.

Am afraid, yes. The difference between abortion and infanticide is when and where death took place.
To determine this, autopsy is inevitable.

By dependency of the mother, I am referring to foetus feeding, breathing and passing waste via the umbilical cord without which they wouldn’t exist. It is purely an anatomical question and outside the remit of law.

By the way, babies do get born prematurely. If they are born alive, they are humans irregardless of age.
