Didn’t the 2010 Constitution remove and abolish such offices?

I beg to differ, cases solved at the village level by the elders in most parts of Kenya are the kind that would clog up the justice system. Especially the kind that involves the unique cultural practices of the community.

But don’t you see how these Headmen could be used by the State machinery to discourage and report dissent however justified?

Furthermore shouldn’t the Government be improving and streamlining whatever ails the Justice System instead of using such controversial and unorthodox methods?
Not everyone believes in the arbitration of elders and you can’t possibly coerce Folks to be adjudicated by them.

Not everyone believes in the arbitration of elders and you can’t possibly coerce Folks to be adjudicated by them.
I understand where you coming from (central Kenya) if I am not wrong, people from other parts of Kenya, prefer the traditional dispute settlement, that's why a bulk of cases in court are from Central Kenya.
In our current dispensation, we can't go back to the dark days of spying on each other, likewise the right to dissent is inherent and no one has the power to interfere with it, so long as it doesn't affect the rights of others.

Hii mambo ya kuingiza pesa kwa shughuli kama hizo inaweza leta shida. They may no longer be viewed as neutral arbiters. We might also end up with a new breed of elders, purely motivated by money. Maybe they should have been supported indirectly na vitu kama airtime, transport, viatu, kofia, koti mrefu za beige na brown etc. By paying them, you are attaching a price to a priceless service, and what you regard as payment may actually be perceived as an insult. Something else, the payment may not reach everyone playing such roles, meaning disgruntlement and dissatisfaction will set in. Voluntary community service should remain just that.
