What is stopping Chebukati from including Miguna? There is no law that says someone in the diaspora/forced exile cannot run for governor. If IEBC refuses to include Miguna, they will be contravening his right to run for office. All the more reason to push for Miguna's inclusion in the ballot.

According to what IEBC have put up, they've just mentioned handing in of relevant documents. They haven't said it has to be in person.

Yes, requirements that would lock him out include holding a valid national identity card or passport which wanjohi's government has refused to hand back to him, in spite of several court orders. If they can disobey court orders, what is stopping Miguna from returning to run for governorship?
