You may recall that Public Order Act in the form it is today was one of the products of the IPPG reforms of 1997 which came about as Moi ceded some ground after a lot of agitation by opposition and civil society organizations.
True, the law says the convenor will notify the OCS. There are situations that may make the OCS advice against the meet or procession being held where and when proposed. However, political twisters will make it look like it is denial of permission so that they play victim.

Edit: I have deliberately avoided the RAO question because I do not have enough information about what he was doing yesterday.

We have all seen the response from the Mumias OCS and it clearly does not offer alternatives on how the proposed fundraiser can be held while complying with the law, the OCS ends the letter by giving an order that no gathering should be held.

Advise provides a way around obstacles, it does not add more obstacles. Uhuru is abusing the state machinery.

As you saw I started by tracing the history of the Act as it stands today. The opposition then felt they needed Police to protect them from Kanu goons. It has not been an issue the last 23 years and has guided the conduct of meetings until recently. Our unpredictable courts may rule the Act unconstitutional then what?
