Lovers Arrested Making Out Inside Car on Thika Road, Causing Traffic Jam

A woman caught making out with her boyfriend in her car in the middle of Thika Road, consequently causing a traffic pile-up, was slapped with a six-month jail term and an alternative fine of Ksh20,000.

Appearing before the Makadara Law Courts on Thursday, January 24, the woman pleaded guilty to causing a disturbance and obstructing traffic at Thika Road Mall in Roysambu.

The magistrate was informed that the traffic officers manning the road were drawn to the traffic snarl-up.

While seeking to establish the cause of the jam, they found the woman in a compromising situation with a man in their car, which was stopped in the middle of the road.

The cops told the court that they politely interrupted the session and asked the lovebirds to move to drive away but were faced with hostility.

Enraged by their request, the accused allegedly began hurling insults at the officers who were armed and even reportedly dared them to open fire.

Officers reported the drama that unfolded on January 24 at the Kasarani Police Station. Colleagues responded and headed to the scene.

The accused was booked and asked to appear in court to answer to charges levelled against her.

With a guilty plea for both offences on record, the magistrate slapped the lady with a Ksh10,000 fine for each offence or an alternative of six months imprisonment.

The judgement was within what is stated in the Traffic Act and the Penal Code, which prescribe consequences for obstruction and disturbance.

"Any person who leaves any vehicle on a road in such a position or manner or in such a condition as to cause or to be likely to cause any danger to any person shall be guilty of an offence and liable (a) for a first conviction, to a fine not exceeding Ksh50,000 or to imprisonment for a term not exceeding one year," reads Section 53 of the Traffic Act.

While Section 95 of the Penal Code reads, "Any person who - (a) uses obscene, abusive or insulting language, to his employer or to any person placed in authority over him by his employer, in such a manner as is likely to cause a breach of the peace; is guilty of a misdemeanor and is liable to imprisonment for six months."

Thursday, 26 January 2023 – A 26-year-old lady was charged in a Nairobi court for insulting police officers who caught her making out with a man in a car outside Thika Road Mall. The court heard that the accused, Tabby Ndung’u, hurled unprintable insults at the cops and dared them to shoot her.
The police officers on patrol found traffic and upon investigating the cause of the traffic snarl-up, they found Tabby and a male companion kissing passionately in the car. They had stopped their car in the middle of the road, obstructing other motorists. Tabby got out of the car and insulted the cops after they ordered them to drive to ease traffic. The officers reported the matter to the nearby Kasarani police station, leading to her arrest.
She pleaded guilty to charges of creating a disturbance and offensive conduct and was fined Sh 20,000 or serve six months in jail.
