Once upon a time, there used to be a sensational soap opera/courtroom show/reality TV show on our prime time TV, and the stars were a close-knit family called The Ngiritas!
What are our esteemed courts waiting for to conclude the case - and by concluding I mean either convicting them or throwing the case out with reasons.?

Questions have emerged on how Kenya Rural Roads Authority (KeRRA) Procurement Manager Margaret Wanja Muthui obtained a court order reinstating her to the position despite being deployed to State Department of Infrastructure.
Wanja filed two cases in an attempt to secure an order stopping her deployment.

The Standard has established that the two petitions were filed eight days apart at the Employment and Labour Relations Court in Nairobi.
They were, however, heard by different judges, who also issued varying orders.

The first petition, No EO19 of 2021, was filed on February 15, 2021 and placed before Justice James Rika on February 16. In this one, she complained about a letter issued to her dated February 10, 2021.
The letter, she said, required her to report to the Ministry of Transport, Infrastructure, Housing and Urban Development and Public Works for the assignment of duties.
Court proceedings dated February 16, 2021, indicate that Justice Rika declined to reverse the letter on an ex-parte application.
Certificate of urgency
The judge ordered Wanja to serve KeRRA and the Ministry of Transport. The hearing date of the case was to be issued in the registry. The suit was set for hearing on February 26.
Three days to the hearing of the first petition, Wanja filed a similar case, petition No EO 27 of 2021 at the Employment and Labour Relations Court in Nairobi.
The case filed on February 23, 2021 was placed before Justice Maureen Onyango. The petition was filed under a certificate of urgency and was heard on February 24, 2021.
Justice Onyango suspended the letter deploying Wanja to the ministry and reinstated her to the position of Procurement Manager, KeRRA.
On obtaining the orders on Petition EO 27 of 2021, Petition No EO19 of 2021 was withdrawn on February 26.
“In the meantime, the letter dated February 10, 2021, issued from the second respondent (KeRRA) deploying the petitioner (Wanja) to the 1st respondent (Ministry of Transport, Infrastructure, Housing and Urban Development and Public Works) be and is hereby suspended pending inter-partes hearing of this application (Petition EO 27 of 2021),” read part of the order issued by Justice Onyango on February 24.
Further Order Number 3 read: ”The position subsisting before issuance of the letter dated February 10, 2021 is reinstated pending inter-partes hearing of the application.”
The case was to be heard on March 15, 2021. Justice Onyango could, however, not handle the case at hearing stage as she had proceeded on leave. The matter was placed before Justice Nduma Nderi on March 17.
Justice Nderi ordered the Ministry of Transport, KeRRA and the Attorney General to file submissions within 14 days and extended the interim orders reinstating Wanja to the position of Procurement Manager at KeRRA.
Wanja in the petitions wanted the court to order the status quo prevailing before she was issued with the letter be maintained so that she may continue serving as KeRRA Procurement Manager.
She said the letter removing her from the procurement manager’s position at KeRRA and deploying her to the Ministry of Transport was in blatant breach of an earlier judgement delivered on February 19, 2019.

The Director General of Kenya Rural Roads Authority (KeRRA) Mr Philemon Kandie has come under serious criticism over abuse of office and use of excessive power to control other departments to aide his looting schemes. He is the man behind unprocedural transfer of one Julius Gakubia from his plum position in the maintenance department to strategic department.
The move was part of Kandie’s ploy to plant his cronies in strategic departments to loot millions in kickbacks through a long list of dubious
construction companies being favoured in various counties with constructions projects.
The rogue director and a clique of top managers have also registered firms which are being run by proxies that must win lucrative tenders and their payments made promptly.
Sources further revealed to Kenya Insights that Kandie is sexually harassing and bullying employees or colleagues of the opposite gender including procurement manager Margaret Wanja Muthui whose case is still pending in court.
Kandie wrote to Mrs Muthui on Febuary 10, 2021 about handing over in reference to letter No KeRRA-10-71-Vol 2-14 dated 10 February 2020.
“…..following your release to report to the principal secretary ministry of Transport, Infrastructure, Housing and Public Works, you are required to ensure a smooth handing over to incoming acting deputy director supply chain management. ….please arrange to hand over all the functions, responsibilities and assets of the office of the deputy director, supply chain management to the incoming officer Catherine Kangangi…” the letter read in part.
He picked Kangangi, his mistress with whom he has been spotted in secret places to oversee supplies since he considers people like Muthui an enemy and part of a cartel that did not want him at the top of KeRRA leadership.

Staffers and seniors managers were pushing for an outsider to take up the DG slot at KeRRA and the same to replicated at KeNHA when Mundinia exist.
Though his plan to deploy Muthui to the Transport ministry appears to have hit a snag after it was suspended by the labour court, Kandie who boasts of powerful political protection from Baringo Senator Gideon Moi is still lobbying to take over from Peter Mundinia, the current Director General at Kenya National Highways Authority (KeNHA) whose term is set to expire later in the year.
Employment and Labour Relations judge Maureen Onyango reinstated Muthui to her position until her case is heard and determined. This was the second time she was being deployed for raising concerns over inflated tenders for road constructions.

halafu tukiambiwa judiciary kuna shida ,watu wanasema judiciary is independent. Who oversights judiciary excesses? Judiciary should be working in sync with executive or vice versa .

I am fully aware that some characters in this very forum would respond glibly when the issue of corruption touching on Uhuru's relatives was brought up. It was always, ' where's the evidence'? Yet the court proceedings were fully publicized and the evidence availed but the courts would rule against the prosecution. These characters would side with the Court citing that the ODPP was incompetent. What is different now? Is it because it doesn't touch a Kenyatta?
Let them steal and go scott free. Even the useless woman who claimed her millions came from land that has never been tilled was eventually able to access her ill-gotten wealth. Kabura and Waiguru are still swinging their arses in public. Kenyatta's funny looking niece is still heading KICC despite misusing billions. Kenyatta's other niece is still loitering in Nairobi after milking the Health Ministry.....
Let them steal...ama people have to come out of Ngina's womb or related to her so that they can't be prosecuted and if prosecuted can't be convicted?

Kwani GoK hawatambui internal controls?? Every scandal points to non-existent control systems, it should not be so easy to lose money, the National Treasury must step up.

I do not really think it s futile. At least the dyed-in-the-wool defenders of the Judiciary's independence without question have seen something to challenge their moral high ground. It might just persuade them to reevaluate their position and demonstrate the fact that we are not going to win this war by pointing fingers in one direction only, when the war is against a huge web with many pathways.

I acknowledge that workers have rights but also appreciate that the contracts the workers signed must have bound them to abide by the terms set out in the code of conduct for civil/public servants that has provisions for interdiction and suspension when cases of misconduct in office are being investigated. I assume the provisions are well meant to ensure the public does not suffer further prejudice because of the officers continued presence in the office.
