We have been wondering how Uhuru will eventually betray Raila and also why he needs him for the BBI.
I think it is becoming painfully obvious for Raila that he is not going to be given the RAILA TOSHA leg up from Uhuru and that possibly Mudavadi and Gideon Moi are the go to candidates.
Based on the recent HNIB report it seems the goal for Uhuru is to avoid a referendum all together just like I suggested in previous posts and replies to the likes of @bigDog and our resident government apologist @Mwalimu-G.
There is no way Uhuru would accept to put the fate of his reincarnation project in the hands of an electorate that want to see him hanged unless he has control of the outcome i.e rigging.
Apparently, Raila needs the referendum so that he can use it to campaign for his 2022 bid now that he has the luxury of state funding. However, Uhuru doesn't want the referendum because he might lose at the count assuming it is free and fair. No wonder Raila has been telling the DP to lead the NO camp.
If Uhuru gets his way and the bill goes through without a referendum, Raila won't have any bargaining power. His role will have reached its end and Uhuru will just discard him to the wayside for his preferred candidate.
Now you can probably understand why there was a KAMUKUNJI DECLARATION rally where Raila was meant to appear before a last minute call from statehouse dissuaded him from dropping a bombshell.

Deep State, System and State House do not want a Referendum ahead of 2022 elections.
But they want BBI to legally go through.
The #CerelacCoalition has no objection.
ODM, a partner in the handshake, have eyes on the Referendum.
WHY DOES ODM WANT A REFERENDUM?
1. Helps mobilize and re-energuze networks without expenses
2. Money. Some which will go to elections
WHY IS #CerelacCoalition GOING EITHER WAY?

HOW DOES DEEP STATE HOPE TO AVOID A REFERENDUM?
This is the crux of the Advisory.
So, a committee has sat within the Deep State and concluded you actually do not need a referendum to adopt the BBI.
1. Referendum, through a Popular Initiative only happens if..
A) Bill is NOT passed
or
B) There is a 255 (1) issue (See attached)
2. So how is a bill NOT passed?
Majority of the members in both houses. So it is simple majority of all the membership of the house.
Essentually 50+1
For a referendum to happen therefore, ODM must vote against the bill in parliament and hope #HustlerNation MPs join them in that vote.
3. The other path to a Referendum is...If 255 (1) is NOT impacted.
That is the patg Deep State and System is banking on.
Question? Who decides it is NOT impacted?
Largely, the constitution is Not express, therefore leaving the decision to the Executive.
The idea is to have BBI passed in both houses
Once that is done the President, will refer the bill to The Attorney General for a legal opinion on whether any part of 255 (1) is impacted.
Do you need to wait for AG opinion?
No.
Because HNIB has a sneak preview
1. He will argue only the protected provisoonsin the bill of rights to Privacy are impacted via the Data ammendment.
That needs a Referendum.
That referendum question on data should not cost the Country Shs. 15b.
So, the rest of the BBI will be signed into law and that small bit will be the 7th ballot in the 2022 General Elections.
But, some Lawyers and analysts, HNIB engaged asked,
1. Having MPs sit in the Executive as PM
2. Senate role has changed by having Women Reps sit
3. Judiciary Ombudsman
And many other questions...must go to a referendum..
The Deep State answer is Singular in phrase and Arrogant....
" Go to Court..."
Therefore the only path to a Referendum, if ODM still want a Referendum, is voting against the BBI in Parliament.
