Boss,the point is not about ownership of the wild plants. The point is about getting into someone's property unauthorised...
That's what constituted the crime. The wild plants were used as evidence to prove beyond reasonable doubt that the two entered,unauthorised,into someone's else's property and benefitted from the said unauthorised entry. By virtue of having grown in the shamba,the weeds belong to the shamba owner.
Actually,two crimes took place. Trespass and theft.
