Why is Chebukati jumping the gun and putting the cart before the horse? Is it because he is guilty as accused?
Could he be stalling and stonewalling and why?
When one is defamed, they rush to Court to defend their esteem and wait for the Defendant to bring their evidence and defences to Court.
Why would they want to receive the evidence even before a lawsuit is commenced?
Mind you @Aviator, the pre-trial period before a lawsuit officially commences, the Judge affords both parties a chance to exchange documents and evidences and interrogate witnesses (Discovery).

But to be honest, I also see some mischief on Raila’s allegations as well.
Supposing, the Court orders Raila to produce his evidence (in this case the tape) and Raila says he didn’t have it anymore or was lost or damaged and that he has witnesses to that end.
What options will the Court have? Will they take Raila’s allegations prima facie and won’t Chebukati’s standing been smeared and lowered?
