If anybody is ever injured in a motor vehicle accident, they are liable to a full 100% compensation from the insurers of the vehicle at blame. Infact, their is no limit to the cover that pertains your well being. The hospital bill should be covered 100%. In case of death there is also compensation that should not be less than 2.5m that should come from the insurance company.

Most Kenyans do not know about this regulation and sadly let insurance companies get away with it all the time. I have seen matatu passengers get hurt and they just walk away with lifetime injuries without asking for compensation from the matatu insurer, also when death occurs family members should follow up with the insurance company for compensation no matter how painful it can be loosing a loved one that way.

If I were a lawyer I would make it my personal duty to seek justice for such families and ensure the insurance companies do their duty instead of hiding in people's ignorance.
 
And with the simplified procedure for claims below 1m, then this should be easily done without necessarily involving a lawyer.

In the US there is a whole indsutry centered around this refered to as "Ambulance chacers" basically lawyers that hang around hospitals and accident cites to get clients to file claims. People look down upon them but i believe they do a very important job. Why are all this jobless law graduates not tapping into this sector am not sure? Maybe the Insurance companies are owned by powerfull tycoons or maybe the Insurance companies are too corrupt and would rather bribe and compromise the lawyer than compensate the victim. I have seen some shocking cases where lawyers seem to sabotage their own clients.

It is sad that Kenyans feel powerless in such kind of scenarios, even public transport owners, even if it is just to clear their conscience should advice their passengers incase of an accident to file a claim

Problem with our lawyers is that they are the devil's themselves.
I remember a case a long time ago when a lawyer disappeared after receiving compensation for some RTA victims. Some 50+m in the 90s.

Those lawyers who chase accident victims are the worst, they either take bribes from insurance companies to throw the case or eat the compensation outright, Kanairo wezi wa suti ni wengi kuliko wa mabavu

thus the importance of people to know that they can actually follow up on these claims on their own without involving lawyers. Basically Kenyans need to know their rights
 
Oh, I thought that such claims are tied to the type of cover since most matatus only use 3rd party and even for us with comprehensive, unafaa uwe na 'excess cover'. I think they usually charge 500/- per seat/annum?

Third party covers, everybody else but the owner, that is why it is mandatory, and even if you are involved in an accident and you also have a third party, you can repair the vehicle and claim for reimbursement from the party to blame (their insurer), as long as you have a police report of the accident
 
You will also not be shocked that the police in the traffic office have contacts of those ambulance chasers and they will often direct you where to report the case halafu wanapata cut yao. That is how you see cops driving big cars and building big homes.

There was that lawyer who disappeared with compensation for the prison warders who died on Thika road in the 90s.
