Your question is theoretical. I can only say that campaigns are designed, executed, evaluated, redesigned or reinforced and the outcome is never clear until just a few days before the vote. Messaging for this one would be easy and it would pass.

P/S - It is the reason people tried so hard to block it from going to a plebescite.

Our Court system is not up to scratch. Not all cases should go to Court. It is unwise and unpragmatic to think that every issue should be determined by the Courts however petty, far-fetched or frivolous.

In this instance I am tempted to see this BBI suit as abuse of process.
Why do they want to fight it in Supreme Court when the case has failed in the first and appeal instances? Do they have new evidence? Can’t they see the Public really hates this thing?

It’s the high time that Kenyan Courts started checking the merits of cases going to trial. Here in UK, the Crown Prosecution Service which prosecutes cases on behalf of the Police and Government has to ensure that all cases have reasonable prospect of conviction before commencement of trial. That entails sufficient evidence and a public interest to the case.

Here in Kenya, it is not uncommon to find a Judge entertaining a case with no verifiable evidence at all.

I hear they are going to seek some clarifications and interpretations on issues they feel the lower courts "over-reached".

I can confidently assure you, without fear of any doubts whatsoever, that this will be what we call in the trade a fishing expedition and at best a shot in the dark.
They will criticise and throw mud haphazardly and in all directions at the recent ruling hoping that some will stick.
