Controversial but correct ruling delivered @Mwalimu-G in my opinion.
It is disputable, by reasons of logic, common sense and natural justice, whether a Court or any Authority can force a Couple who have fallen out to continue living together in marriage. People can’t be made to stay married to people they no longer love.
On the other hand, this judgement is sound and perfect law. If a Couple fall out and express an intention to Separate and Divorce for whatever reasons, one wouldn’t expect them to continue enjoying the perks and luxuries of marriage especially romance and coitus.
The law presumes that such a marriage has irretrievably broken down and sex and romance are out of bounds.
Should a Couple continue or resume sex and romance, the law presumes that they have made up and that the marriage is still subsisting.
