The Public Transport (Motorcycle Regulation) Bill – Key Highlights

The bill was tabled in the National Assembly on 12th February.

Key Provisions:

Regulation & Registration

  • A County Motorcycle Transport & Safety Board shall be established.
  • Motorcycle operators for commercial purposes must register with the respective County Executive Committee Member and pay a prescribed fee.
  • The County Executive Committee Member shall submit a register of licensed operators every three months to the NTSA.

Tracking & Compliance

  • All commercial motorcycles must be fitted with a tracking device approved by the County Executive for real-time location identification.
  • Owners of commercial motorcycles must register with a Cooperative Society recognised under the Cooperative Societies Act.

Licensing & Safety Equipment

  • Only licensed riders with a valid driver’s or provisional licence and a written employment contract may operate commercial motorcycles.
  • Owners must provide riders with:
    • Two KEBS-standard helmets of the prescribed colour.
    • Two reflective jackets of the prescribed colour.

Passenger & Load Regulations

  • Riders must not carry a load exceeding 50kg and an adult passenger at the same time.
  • Passengers must properly wear a helmet and reflective jacket.
  • A child under 13 years may be carried with an adult passenger, provided they are seated between the rider and the passenger.

Offences & Penalties

  • Riding on pavements, pedestrian walkways, or non-designated areas:
    • Fine of up to Kes 20,000 or six months imprisonment, or both.
  • Engaging in group intimidation, threats, or harm:
    • Fine of up to Kes 100,000 or one year imprisonment, or both.
