Wycliffe Aloys Orinda, an accused person who became famous after confessing smoking bhang to understand the BBI, has protested after he found himself in the same cell with Lawrence Warunge, the university student accused of killing five members of his family.

The petty offender appeared before a Nairobi court on Thursday, January 28, claiming that his life was in danger and sought to be freed from the Industrial Area Remand.

He added that he was not at peace sharing the same cell with Warunge who had confessed to the gruesome murders of his family members in Kiambu County.

He noted that his belongings had also been stolen while at the remand.


"Your honor, they took off my shoes and trouser and I am being held with another suspect who killed five family members. I am scared my life is in danger,” he stated.

Due to the claims, Orinda sought the court to release him on the basis that the remand was not a safe place.

Nairobi Chief Magistrate Martha Mutuku, however, ruled that the suspect was to undergo a mental examination at Mathari National Teaching and Referral Hospital, Nairobi County.

The suspect had been accused of creating a disturbance at his wife's workplace in the city centre, Nairobi County.

It's reported that Orinda stormed the offices demanding to see his children. Orinda pleaded guilty to the charges.

The suspect recently had rocked the social media waves when he confessed in court to using bhang and other substances in order to be attracted to older women.
 
Petty offenders need to be held more leniently, au sio @Pamba 1 also, si he is entitled to bail since his sentence is max 6 months korokoroni..

Nevertheless there are no kinder way to convey this but it has to be said in very strong terms that bail is not candy to be dished out generously and liberally. Many folks argue of bail being an outright right but I don’t think this is the case.
In order to grant bail the court must have serious regard not just to the Suspect’s plight but also to the Claimant’s and the whole Society as well.
For this very reason, and for purposes of deterring crime, giving of bail is a very intricate balancing act which hedges on the following:
- is the suspect a flight risk. Will he surrender to court when needed?
- is there a likelihood of the suspect offending on bail?
—will the suspect interfere with prosecution’s witnesses or otherwise obstructing the course of justice?
-And finally but very important, is the suspect safe from his accusers out there?
If these conditions are not met, bail needs to be denied.

Don’t forget also that it matters as well the kind of crime perpetrated. Murder, rape and other serious sexual offences require stricter bail conditions.
And lastly, in my opinion, it depends on the judge on the bench.
