Football Kenya Federation (FKF) President Nick Mwendwa has explained why they decided to do away with a limited company to run the Premier League.
The federation boss has revealed while taking over the running of the top-flight from Kenyan Premier League Limited (KPL) whose five-year mandate had expired, the federation had thought of coming up with another company to manage the same.
However, Mwendwa now says his discussion with the world governing body, Fifa, and the number of court battles he had tussled with KPL over the period he took over the running of FKF, forced him and other members of the federation to think otherwise and do away with the formation of a company altogether.
“We also had plans to have a company to continue running the league like KPL, but we realised we could not have a company because Gor Mahia cannot have shares in a limited company here in Kenya, so there is no way all the 18 clubs will be represented in that company, so we will be lying to the clubs if we formed the company,” Mwendwa told FKF TV.
“Fifa also told me we have had long tussles with KPL in court, you know how long FKF and KPL have battled in courts, we have fought in court for the last four years that I have been the President, so we said now we have done away with KPL, we forget about forming a new company.
“Fifa also told me to forget about forming a company, so we told the transitional committee, we will not have a company, but we will allow you to run the league as a committee, we will open for you an account and put in money and allow you to make your own decisions.”

Ex-Gor Mahia official Omondi Aduda has openly castigated plans by Football Kenya Federation (FKF) to hire foreign referees to handle derbies involving the champions and AFC Leopards.
On Thursday, FKF President Nick Mwendwa exclusively told Goal they have already mooted plans to hire foreign referees for contentious matches in the Premier League including the derbies involving Ingwe and K’Ogalo.
According to Mwendwa, the move will help end contentious issues that arise from such matches involving the giants of Kenyan football and further said they will also hire foreign referees to officiate in league matches especially when two or three teams are fighting for the title with few matches remaining to the end of the season.
Aduda, who contested for the presidential seat and lost during the past FKF elections, has now told Goal that Kenya has competent referees capable of handling such situations and gave an example of a recent Caf Champions League match between Simba SC of Tanzania and Plateau United of Nigeria which was officiated by Kenyan officials in Tanzania.
“I don’t support the idea [to hire foreign referees], we already have top qualified referees in the country who can do the job,” Aduda told Goal. “It is unfortunate for the federation to think along those lines, I don’t think it is necessary to take such a decision.
“Two weeks ago, it was Kenyan referees who were in charge of the Caf match between Simba and Plateau United and no questions were raised after the game, it shows you even our very own can do the job, they have done it before and can still do it.

Football Kenya Federation (FKF) President Nick Mwendwa says he is saddened to see Mathare United and Zoo FC removed from the FKF Premier League.
The two ‘rebel clubs’ have been suspended from the top-flight and scrapped from the 2020-21 fixtures after they refused to endorse the broadcast deal between FKF and StarTimes.
Mwendwa says they gave the teams more than enough time to sign the document but they refused and FKF expunged them from the league.
“I am saddened that the effort put by the two clubs to reach where they are and what they are doing now,” noted Mr. Mwenda.
“Mathare United, 26 years old has refused to sign a contract and they don’t have an alternative, how will they be helped? I am saddened but we don’t have options, the only decision we had was to remove them,” revealed Mwendwa.
Battling nothing
Mwendwa urged the teams to wait for next season and join the National Super League (NSL) but under the same conditions.
“Now they have to wait until next year and join NSL but they should be aware that we also have sponsors in the lower tier so it will be difficult for them again, and division one also we have sponsors, so they will have to follow the law or stay out,” he said.
Mwendwa has also revealed how FKF made repeated efforts to have the two teams endorse the document before they were finally suspended.
“The only option remaining is for the two teams to sign to NSL next season but they should also know in NSL they will be required to sign an endorsement similar to that in the top-flight for sponsors, so I don’t know if they will be ready to sign it,” added Mwendwa.

Mwenda said FKF Premier League is not for one but for many clubs, the league belongs to FKF and the constitution states clearly the league belongs to FKF and is planned by FKF and not for one club, and the constitution says the rights are for FKF and for all members and how to spend the sponsorship it is the prerogative of the National Executive Committee of FKF to decide.
Mwenda reiterated that the federation had no time but axe them so as to safeguard the sponsorship.
