When the Constitution says the President appoints the judges whose names have been forwarded by the JSC no one can stop that process, not even the JSC or Parliament who are the people's representative.

This is the equivalent of the CJ refusing to swear in the President or his DP after being declared the valid winners because it comes to light that one of them did not clear form 4, would it be proper?

Or the Speaker of the National Assembly failing to swear in all MP_elect because it comes to light a few of them had previously been convicted to serve jail terms exceeding 12 months, would that be proper?

In short the President is not a rubber stamp.

And how would he have done that? Given that the recruited only come to him after they have been recruited?
If he did deign to give an advisory during the recruitment and before its over,that would be meddling. Okay,the theory part is over.
He and every other power with vested interests does engage in meddling through emissaries real or imagined. That's the practical part.

The President like any other Kenyan is allowed to submit evidence that proves impropriety in the conduct of candidates being interviewed for whatever position by the JSC, it just has to be submitted at the appropriate stage.

In fact the President can still submit the evidence he claims to have but only after the Judges have been appointed and sworn in then the JSC can begin the process of their removal, the issue here is that no one has the power to stop their appointment and swearing in.

But again,if he has a dossier on a recruited individual(s),which he didn't present during the recruitment, for reasons only known to himself,he might use it to decline to appoint the recruited individual(s).

Boss, interviewees are known to the public and the public is infact invited to give any evidence of improper conduct.

Investigative agencies, KRA and the NIS (which the President claims forwarded the evidence he claims to hold) are also required to look into the backgrounds of each interviewee and submit their reports to the interviewing panel, which they did and for some reason gave the interviewees clean reports.

Further still the President is represented in the JSC by the Attorney General who speaks on behalf of the Executive, the President is by no means excluded in the running of the JSC, he had plenty of time to submit the evidence and still would be allowed to do so in the case of their removal.
