First, guys, forgive me for starting a new thread on the same issue as posted by @Deep Sea .

Any way this is my two cents on the matter.

The guy in the video deserves to go to jail, not for having sex with his niece, but for being totally stupid. It is @Mwalimu-G who regularly says that there is nothing as disastrous as giving an idiot a smart phone with a camera. Right here you see the results; a brain-dead imbecile basically ending his life.

To be fair, this is a widespread stupidity among young people. If they are not taking and sending each other 'nudes' they are recording themselves having sex. FOR WHAT? WHY? You can't get a coherent answer. And then the next thing you here is that they are complaining that they are either being extorted or that their images have been disributed without their consent, usually by their ex's. Now, seriously, what would you be thinking recording yourself having sex? What would you be thinking sending a random dude or girl your nudes? For that and that alone, you - like the Kericho guy - need to be jailed.

The other issue about the Kericho video is whether the dude should go to jail for having sex with an underage girl. The law in Kenya defines underage as being below 18 years. This law was passed about 15 years ago, and was sponsored by Njoki Ndungu, a very bitter feminist who once represented her mother in court against her FATHER.

It is a bad law which has seen thousands of men and boys jailed for lengthy terms for basically having consensual sex with their girlfriends. There is nowhere else in the world, for example, where a 19-year old boy can be jailed for 15 years for having consensual sex with a 17-year old girl. NOWHERE!

I believe the age of consent in Kenya, like in the rest of the world, should be lowered to 15 or 16. This will not only allow for pro-active sex education among this age group but also remove the hypocrisy that surrounds sex in this country.

Looking at the Kericho video, for instance, it is obvious that the girl involved is not a virgin. In fact, to use crude language, she can really take it and shake it. It is not her first time, and she was obviously enjoying herself. Was she groomed as some feminists will allege? I do not know . What I know is that she was not raped. To make her some sort of victim for whom the man should be jailed for life is down-right silly. She was a willing and enthusiastic participant.

The long and short of it is that perhaps we need to teach our children better phone etiquette, as we also impart sex education and adopt laws that are realistic to our situation. Not everything in life should be recorded, and not all sex should be punished.
