Haha! Mpesa fraud imezidi buana. Leta ile story ya Langata's Kristy Homes where a tenant stayed for over 3 years using fake Mpesa messages.

The landlord has thus suffered losses amounting to almost 2M in rent arrears.

Nairobi Tenant Fakes Rent Messages, Lives Free For 37 Months

A Nairobi tenant was on Tuesday, December 14, charged in court for allegedly defrauding his landlord rent for years.

Appearing before the Milimani law court, the 31-year-old man, Emmanuel Osome, was charged with five counts of fraudulent misuse of electronic data contrary to the law and computer forgery.

While making a submission before Senior Principal Magistrate Bernard Ochoi, the investigating officer stated that they launched a probe into the matter following a request by the tenant's landlady.

The landlady of Kristy Homes in Langata had written to the Directorate of Criminal Investigations (DCI) asking them to investigate what she suspected was fraudulent payments of rent by the tenant

She accused the tenant of submitting edited messages of mobile money transactions purporting to have paid rent for 37 months.
“In the letter, she complained of one Emanuel Ian Osome who has been her tenant at Kristy Homes in Langata and has been paying house rent for 37 months,” the report read in part.

As required, tenants would pay rent by sending money to a bank account provided then share the transaction message with the caretaker. However, the tenant edited the messages before submitting them after which he was issued with receipts.

A probe into the matter confirmed the claims by the landlord that no money had been sent to the account.
While presenting a report from the Communications Authority of Kenya (CAK), the investigating officers told the court that they had established that the accused scripted the message.

He pleaded not guilty to all counts. Through his lawyers, he pleaded for leniency stating that he was negotiating with the landlord.
Nonetheless, the court granted him a Ksh200,000 bail. The matter will be mentioned for pretrial in 14 days.
