For most of us who abhor and hate pain, BDSM doesn’t cut it or even make much sense. A shag should be pleasurable, enjoyable and gratifying. It shouldn’t be painful, punitive or savagery.

In Law School, the Criminal Law module has a unit by name Sexual Offences which attempts, among other things, to define all known sexual offences ranging from Sexual Assault (touching someone for sexual gratification without their consent) to rape (penetration by force or under duress).
You will notice that what makes sex illegal is simply the conditionality of consent.
I say all this to make the point that BDSM is a very hard area legal wise. This is because of the assumption that it happens with the consent of the parties involved. But as you know, the law can also be contradictory because it is the case that one cannot give consent to be hurt or injured by another.

BDSM participants are prone, susceptible and given to horrific injuries and even death.
Two years ago there was a case of a Lady who died because the Man she was BDSMing with drove his folded palm into her vagina with force tearing tissues and sinews.
The presiding Judge ruled that BDSM is like contact sport - you are presumed to have given consent to possible injuries when you participate.

The Guy was found to be criminally blameless and was acquitted!
