You would have to show a significant number of such cases happened. And by significant, take the total number of mail in ballots and show what % are invalid since the voter would be dead. Then you have a case.

You nullify that 1 vote not all of them.
It all shows the end can never be justified. Unless the electoral body proves that it is an error, any unbiased court will ask for verification. Dead men have never voted. Ata kama ni kushinda, shinda when your opponents feel they lost fairly.

There is always a margin of error accounted for in the counting for just such an anomaly. The burden of proof would lie on the person going to the courts to show that the number of absentee/mail-in ballots sent out to dead people and who "voted" surpasses that margin of error and would be significant enough to alter the results.
